The idiot's guide to decertification

Anyone care to write it for me? I have no idea what this would really mean for anyone involved.

lamens term, there is no salary cap, no limit on contract lengths, no ufa, no rfa, no draft, no pension, no insurance (for players), no guaranteed contracts, basically no nothing.

Contracts are a shady area, no one is sure, probably wouldnt matter though, as it would probably lead to litigation rather than the playing of hockey.

The CBA limits what owners can do (signing players younger than 18, the cap, etc.) and outlines the rights players have (contract rights, ELCs, min/max salaries, etc). These things are technically illegal under antitrust laws, but allowed because the players union bargained to these agreements. If the Union decertifies, players could theoretically start bringing lawsuits against owners for some of these things because they wont be bargained for because the union isnt a union because it decertified.

And mozilla needs to add decertify to the dictionary.

I think it's too late this year for them to implement it as a stategy, it takes months to go through the courts just to get things started, so if it was a real option it would be for next year. This year it would be a minor bluff which I'm sure the league would not be intimidated by.

To be honest, it's not really clear what it would mean for anyone involved. There's a lot of uncertainty involved.

Here's a great article from James Mirtle from the G&M where he interviews a professor at the University of Georgia who specializes in antitrust and sports law. I'm just going to give you the link rather than quoting bits of it b/c the whole article...b/c the article is a good one

Mirtle also links to an interesting paper the Prof wrote (the link is to the abstract...click "download the paper" and you'll get the .pdf) http://papers.ssrn.com/sol3/papers.c...act_id=1978517

Lawyers are not all greedy...many are wonderful people (kind, intelligent, and, of course, good looking)!! ... at least that's what a little birdie told me ;)
