Fehr vs Proskauer Rose playbook?

http://www.detroitnews.com/article/2...328/1128/rss16

Games still being played in CBA negotiations. Owners/Proskauer Rose want to shut down/out Fehr (break the union); Fehr (in desperation?) is trying to limit losses and is frustrating Bettman/owners.

Quote:

In the NHL, the tactics on both sides appear to dictate games will not be played until Bettman and the owners deal with Fehr, or the players turn against him.

Bettman and the owners never have negotiated with anyone as skilled as Fehr, and the players never have had an executive director who is so accomplished.

"The conclusion I keep coming to is somehow the owners do not want to deal with Don," Mathieu Schneider, the former Red Wings defenseman, now a special assistant in the NHLPA, told The Hockey News Radio Show last week.
...
Having derived big concessions from the players, Bettman and the owners last week made the negotiations about Fehr instead of the issues that remain.
...
...The players put Fehr back in the room, and Bettman and the owners want him out.

The owners' strategy worked in the last lockout. ...

The tactic is directly from the playbook of one of the most accomplished law firms representing management in labor negotiations, Proskauer Rose, where Bettman once worked.
...
But Fehr had his own intentions. He was determined, as he has been from the start, to address the issues the players want addressed rather than proposals by Bettman and the owners, which have led to huge concessions.

Each of the "we are close" items he listed remain priorities for the players. They also are items Bettman and the owners would prefer not to discuss any longer.
...
When the negotiations are over, the players will have gained nothing. Fehr knows his job is limiting the losses.

But they are mounting.

Bettman trembled with emotions when he talked to the media after the breakdown Thursday. Longtime observers agreed he never had looked so discombobulated, publicly.

But was it anger, or confusion, about whether Fehr had outflanked him without conceding much, this time?

Did the players put Fehr back in the room?

Im gonna take a wild guess that it was Fehr's suggestion that he go back in the room.

That must have been after he told the players that he could get a better deal if they would hold out just a little longer.

NHL has had for a while the reputation as very hardline CBA negotiation team...

"Batterman bullied [the union] into submission," says one sports labor lawyer who requested anonymity. "If one accepts the conspiracy theory of collective bargaining, this means the NFL must be looking for trouble," says another...

No official negotiations have been held. But the hiring of Batterman sent a clear signal to the union. Gene Upshaw, president of the NFL Players Association, told SportsBusiness Journal in April that his "concerns were heightened" when he heard Batterman had been retained, noting that NHL players crumbled before Batterman's hard line.

The NFLPA's outside counsel, James Quinn of Weil, Gotshal & Manges, says that owners "have this bizarre notion that they want to get tough, so they go get Bob Batterman." (Jeffrey Kessler of Dewey & LeBoeuf is also counsel to the NFLPA.)"

The NHL want to pretend they get to pick who should be negotiating on behalf of the PA. What the players should do is either drop Fehr and get screwed or back away from directly negotiating and tell the NHL you're dealing with Fehr or we decertify.

And the NHL simply "suspends operations", negating the PA's decertification. IMO, decert is not a real threat to the owners.

thats the real reason Bettman was foamimg at the mouth.......had nothing to do with the league missing games or fans missing out on hockey......he was mad because he has a formidable opponet...and they are harder to divide and conquer

it is a big can of worms.......you could see the bluster come out when bettman brought it up.

Im sure they have plans for if it happens to minimize its affects.......

imagine no draft............huge draw/money maker for the league.....teams that are sucking or nondesirable will have a hard time getting cheaper contracts...

your one the top three players ...how much will you sign for in your first year..

how many players could get feed up ,walk away and play overseas with no agreements possible in place????

just think about it if it was no worries and helped solve some/or more of your problems.........i would think you would just keep quiet and let the NHLPA fall into your trap.

No doubt that it's a big can of worms. Unchartered waters for pro sports .Sure would be interesting to watch it play itself out though. It might be more exciting than NHL hockey (of late), which isn't saying a whole lot! Maybe the league NEEDS to be nuked and started over from scratch.....and make it EXCITING this time! But I digress.....
