1st round pick
 
I am a bit confused here, if the Ducks don't match this offer theyget a 1st round, a 2nd round and 3rd round pick. But who's 1st round pick would the Ducks be getting, is it the Oils or I am hearing it's their own that the Oil have? If it is the Oils then the Ducks should not match the offer because the Oil will proably suck and they get a top pick.

Teams cannot use draft picks acquired from other teams as compensation for RFA's. As such, you'd get Edmonton's 1st, 2nd, and 3rd round picks. The only way you'd get your own 1st back is if Burke worked out some alternative compensation package (like the Blues sending Scott Stevens to New Jersey when they signed Brendan Shanahan).

Correct that teams cannot use their own draft picks acquired from other teams. However, Stevens went to NJ based on an arbitrator's decision for compensation. This wasn't what St Louis wanted.

Yes, but arbitration was needed because back then there was no compensation specifically spelled out. That ruling was what prompted the NHL to make the draft pick table to avid anything like that happening in the future.

They can't do it then. That is why the Oilers had to reacquire their 3rd round pick from the Islanders. (Rourke trade). The Oilers acquired Rourke and their own 3rd round pick (Previously acquired by the Islanders in the Bergeron trade) in exchange for Anaheim's 2nd round pick.
