This is a tough question because we've never had this situation before. There were no replacement players during the last strike, so it wasn't an issue. My guess would be anyone playing under an NHL contract would be considered a scab. It's possible that they could sign AHL contracts, but I believe all NHL contracts contain a clause prohibiting the player from signing with any other North American team. I know some players signed AHL deals this year, but it's a different situation because the players are not refusing to go to work (and also I don't know if those players had NHL deals for the upcoming season). But even if players are allowed to play in the AHL, any decent prospect called up would immediately join the picket line unless a significant number of NHLers had already crossed.
