The language about cap circumvention is pretty vague in the CBA. What constitutes is can be anything, so long as the league can prove that the intention was to subvert the intention of the rules in some way. I think if it goes before an arbitrator, they're going to have a very easy case, and the Devils are going to have a difficult time explaining the structure of that contract. Their best bet would to try and claim that the extreme front loading is to avoid inflation (i.e. the more Kovalchuk gets payed up front, the more he can invest right away and not have a lot of the value of his contract shrink due to inflation). That's a tough sell.
