All depends on his contract status TODAY. All kids born 1995 finished their MHL contracts 30.4.2012, so now they are "free agents". The same will be with 1996 kids next season etc. So, imagine Nichuskin will be drafted by Traktor, he can sign new contract with club in summer (I believe 3 years, but not sure) or he can go to CHL.
Kids who played MHL this season (like Lipsbergs) can have contract for next season (1995er CAN NOT acc.to rules, thats important difference). Maybe Lipsbergs signed contract until april 2013/2014 etc, I dont know. If he signed this type of contract, it mean he has valid contract with MHL club and can NOT be drafted. If his contract expired 30.4.2012, he can be drafted (my opinion, not sure about it). Rules say:

By not having an adventage you mean преимущественный выбор? Yes, Dinamo Riga does not have it.
