The expiration of the CBA doesn't mean that the owners have to lockout the players. If they don't, the league continues on the old CBA while negotiations are ongoing. The NHLPA can strike in that scenario.
The same kind of situation has been going on with the ConEd workers up there. My buddy is one of them. They don't have a CBA and the ownership currently has them locked out. They're willing to allow the workers to come back to work, but only if the union guarantees they won't strike (a little hypocritical right there).
It wouldn't be a strike in the summer. It would be a strike in October.
