Honestly though, they should just make it so that if the deal goes beyond age 35, it counts as a 35+ contract. That way teams are punished for these deals that obviously won't be played out in their entirety.
If the loophole is there the agents want to expose it as much as the owners. There is going to be some negotiating on these issues, but I think this as far as HRR goes this is the best possible solution for both parties here.
