And why I don't think the NHLPA has any interest in "negotiating". Part of negotiating is also throwing out hypothetical situations against the other sides proposal.
Personally, I think the NHLPA's refusal to negotiate on that point is more posturing than anything else. If they attempted to negotiate it out of the owners' share and the league relented, we see that not only is the league willing to negotiate and compromise, but the NHLPA would lose a talking point. Coming to such a compromise could be devastating to the NHLPA's PR war, which they seem quite committed to maintaining.
