To vorky, salary cap's purpose in US pro leagues is to create a level playing field and enable all teams to make a profit in the environment. No law says they have to make one. It's purely common sense on their part. CBA's on the other hand must follow certain laws when it comes to employer/employee relations. Or as Wikipedia puts it:

Several sports leagues have implemented salary caps, both as a method of keeping overall costs down, and to ensure parity between teams so wealthy teams cannot entrench dominance by signing many more top players than their rivals.
No law forces the NHL to have one, it's the because the owners want to have a financially healthy league.
