Brennan was exempt from the waiver draft, and was not on the protected list (pdf link). So it looks like he fits both requirements.

Was he or someone else put on waivers?
I think that section of the CBA addresses the waiver draft conducted just before the season starts. I read it as meaning that if a player was not protected from the waiver draft because if a suspension nad he comes back to play after his suspension, then the club must make the player available on waivers. But that is only is he is suspended during the waiver draft, not suring the year.

I presume the section is intended to prevent teams for protecting players by suspending the player or something like that.
