Check out the "New Standards of Play" video at usahockey.com (lower portion of the home page). This video does a great job of explaining what the legal use of this stick is.

According to the video lifting the opponents stick to prevent them from playing the puck is a legal play. As long as your intention is to play the puck you should not get called.
