I'm sure you're being facetious, but stuff like that is exactly why I don't think that's the actual penalty.

Besides, the fines for forfeiting 82 games would be too much even for MLSE to absorb.

So although there would be no games played you'd still have 20,000 fans in the ACC for every home game and nobody would be the wiser.

Yeah, but look at your second definition. "By artfulness or deception". There's really no deception in blatantly disregarding the cap like there would be in trying to hide a player's salary via tagging or hiding him in the minors or things like that.

I dunno, I'm arguing semantics. I agree with you, I would have to think they'd consider it the same thing, but who knows.

If they go over the cap, it would be a first. So the league has 2 options:

1- They regard this as something that was out of their control (which is kinda true, since they tried to waive a very good player and it didn't work). In that case, something in the order of a fine + lower cap next year might be imposed

2- They regard it as a very dangerous precedent, especially that the ducks actually circumvented the cap with Niedermayer and Selanne last year. In that case, a very big fine to the ducks + point penalties might be imposed.

But this is the NHL, I think it will be number 1

I don't think it's about picking him up at this point as the teams you mention probably would take him, I think that they want a consideration for assuming the contract in the same way SJ rec'd it from NJ for taking Malakhov.

LA is most probably waiting to see if they can get a pick for taking him.

Are we talking about the salary cap that owners demanded because player salaries were spiralling out of control?
So they got a cap, and now teams are finding it difficult to manage salaries under the cap? That's laughable.
If you go over the cap, you deserve to get punished....severely.
There's no excuse.... you know player's salaries, you know what you have to do to get under....make it so.
