I assume he's got to have that in mind when he opts not to invoke the NMC.
As far as downsides go that can't be seen as a huge one IMO. Oh noes, an NHL team is actually going to pay me to play hockey!
But I'm assuming GM's are able to communicate intentions in such a way as to avoid any question about the results in these situations. If everyone around the league knows Nyls is about to be moved to Omsk would they bother interfering? And if Nyls knows that at least one team out there actually wants him to play, would mind the shot to stay in the NHL?

Who gives a **** at that point?
If he consents to be waived...the Caps would have no control nor would make any promises of what happened when they actually did waive him. So being claimed by another team, after waiving his NMC, would then be another teams headache.
Cartwheels if he waives the NMC...regardless of where he ends up. Just waive the damn thing.

Moscow doesn't have Jagr. That is probably the only reason he would go to Omsk, or perhaps even the KHL (at this point in his career).
than agin, 6 kids... he sounds like a family man and what family man in his right mind will move his family to Russia? and its coming from Russian... Well, i haven't been there in the past 17 years thou... still its a big cultural shock.
