Just because he signed with the KHL doesn't mean he wont play for the Lightning. Chances are if his agent is half decent there is an out clause for playing in the NHL and if not then it doesn't matter too much because both leagues poach each others players.
Joel Kwiatkowski signed with the KHL and then signed with the Thrashers a few days later.

Yes, but Waddell said that he didn't know Kwiatkowski was under contract. I think they are negotiating the compensation..
There is a verbal agreement between the KHL and the NHL not to sign players that are under the contracts.
I don't think the Bolts will do it if Niittymaki signed a contract without NHL release clause.
Back on topic though. Niittymaki is a solid, very experienced NHL-level backup goalie. If we sign him, our goalie duo could be the best in the SE division.

Bettman has said the league would come down hard on any team that even talked to another team about compensation. It sets a horrible precident.
Russia didn't sign the IIHF transfer agreement, making them entitled to no compensation whatsoever. In the worst case scenario, Niittymaki would send his team his two-weeks notice, and then join the Lightning.
My message to the KHL:

Here's a translation of an article that stated that Waddell didn't know that Kwiatkowski had a contract and according to Waddel, they will deal with this situation, whatever he means by that.
