The 85% minimum for Club-elected arbitration is a minimum the arbitrator must award for players that made $1.5m or more in their previous NHL season [including everything except performance bonuses]. So for example, if there was a team-elected arbitration for a player who made $1.5m in his previous season then the arbitrator's award cannot be less than $1.275m.

Clubs are not permitted to walk away from Club-elected arbitration awards.

If you think they won't be getting a cap hit back, you are misguided. Gagne will want to go to a contender, and they don't usually have cap space.

The Kings, where it seems the most interest lies and the most rumors have surfaced about, can take on Gagne's 5.25 without sending anything back.

Waived....lol

As for the Kings, I highly doubt they would take him on with out sending salary back. Not many deals are done these days without salary being exchanged.
