The fact that it wasn't approved won't bear on it at all. I doubt anything substantial happens - reworking the contract is the most I would imagine - but a lack of punishment won't be because it wasn't approved. The Devils didn't pull up a step short here. Everything was out of their hands.

There is actually a stipulation in there about paying a guy too much being an example of circumvention, but pretty sure that's only for new contracts and for purposes of reaching the cap floor.

Yeah, I don't see how any knowledgeable, reasonable NHL fan can be against the NHL on this one. The Kovalchuk deal was blatantly and severely worse then any contract before it. Any.

The NHL is perfectly within it's rights to nix this deal and I agree with them.

Its all about how far you take it

Devils final years + NMC he has that changes to a NTC once his $ drops are clear red flags and cap circumvention

Those final 5 years of his deal will be under whatever league minimum can be estimated for the years and Hossa has no NMC/NTC

Devils made it far too obvious what they were doing

I don't disagree that Lou & Co. tried to pull a fast one. My issue is that there are no guidelines covering what is and is not acceptable.

My guess is that they'll lop off the last couple of years of the deal, bringing the cap hit to around $6.5 - still a good deal for Kovalchuk. The Devils aren't going to lose Kovy. It's just going to cost them a little more.
