If this goes through though, every top player in the next 3 years will have a bogus contract.

And the point is, these teams are circumventing the cap because they can afford to. They'll pay a guy $9m a year but get a cap hit of $3m a year. Smaller market teams can't do that. Budget teams can't do that. It just plain shouldn't be allowed, and good for the NHL to stand up to it.

I think the big question is, where is the line drawn? 17 years? 20 years? 50 years? Why not 100 years?

If the league can prove intent... That's all they need to have a legal leg to stand on.

It's their right to revoke contracts if they break the rules. And it's their right to investigate any contract they wish, if they feel a rule was broken.

My understanding is that the CBA gives the league the right to lay the burden of proof on the club, player and by virtue of the first two, the NHLPA, that there was no intent to circumvent ANY of the rules in the CBA and particularly cap circumvention. They don't need to prove that it does break the CBA, they just need to prove that either the club or the player intended to break the CBA.

The CBA is nothing like regular laws. It's 20% rules, 60% contract laws (which are notoriously murky and ridden with legalese), 19% granting sweeping rights to the league and 1% listing the rights of the NHLPA. Obviously my breakdown isn't accurate, but that's the general intent based on what I've understood.

Ouch..... That doesn't sound like good language for the Devils or Kovy.

You would think they'd at least throw out the usual "We have every intention of supporting our player in this matter". Instead, they're saying that they're digging through the CBA.

I guess we'll find out.

To put some perspective about the money and how Kovalchuk is different from the other long-term deals:

-Hossa makes 94% of his money over the first 75% of his contract.
-Pronger makes 95% of his money over the first 71% of his contract.
-Luongo makes 94% of his money over the first 75% of his deal.
-Keith makes 91% of his money over the first 83% of his deal.
-Richards makes 91% of his money over the first 83% of his deal.

-Kovalchuk makes 93% of his money over the first 58% of his contract.
