Yeah I believe the general rule is that a threat is enough if the person believes that the other person has the ability to act on those threats. At least that is what the deal for the tort of false imprisonment in USA. The law in Canada may or may not be different.

Jason Smith joins a long list of washed-up former athletes who get drunk and smack their wives and kids around. There are so many it's disgusting. I guess they can't figure out what to do with themselves after their careers end.

Here are some other ******** who were arrested for assaulting their spouses:

Brett Myers (a total dick)
Bobby Cox (beat up his wife - an old lady basically)
Sean Burke (plead guilty to beating his wife - apparently ripping out large chunks of her hair)
Warren Moon made a public apology and plead guilty
Dante Bichette

Even Harry Morgan - that's right - good old Colonel Potter from MASH - beat the piss out of his wife putting her in the hospital

I say screw them all - gutless cowards. I don't care if their wives hit them first or any bs excuses. A judge doesn't just tell a guy - you can't have any contact with your wife or daughters - just send a birthday card and you can't drink anymore unless you really ****ed up.

Jason Smith is a piece of crap - I don't give a **** how good he was at hockey.

I would really not condemn him before the actual truth comes out.

He doesn't fall off the ladder for me.

Falling off the ladder for me is pulling a Chris Benoit (who I was a big fan of growing up).

Not read the story, but who was pressing charges? John Connor?

I bet he was drunk, she started spouting off, and he pushed her while the kid was near her.

If he hit her, he is in jail.

That does seem to be the standard scenario for these kinds of things. But the charges seem to imply that more than that happened.

Agreed and we don't agree on much.

There's a lot of pine tar on your ladder.

Not really. It's never right to hit a woman, especially your wife, but he didn't run into a day care with a shotgun and started unloading. He didn't drive up on a sidewalk in Edmonton and go to town. I'm surprised that in professional hockey this doesn't happen as often as we think. These are guys who are used to hitting others every day they go to work. On top of that, I did mention we barely know the whole story, even though some things point to others. There's no point at throwing him out the window when we don't know the whole story.

I agree with this, I just thought that your ladder's standards are a little low. I should have been clearer...

Well, assault can be anywhere from a light, single, open handed slap that she took offense to and he happened to make physical contact with her, or he could have beat her until he knocked 7 teeth out of her. We don't know the whole story, or the back story, so why jump to conclusions?
