The party that presses charges does not have to press racially involved charges.

Hence the harassment/disorderly conduct ect charge.

I'd find it hilarious if somehow the guy didn't mean to be racist, and he just wanted to throw something at a Flyer and happened to have a banana in hand. It's highly unlikely that's the case, but from the outside looking in it'd be kind of funny.

But their won't be a charge for that. He will get a fine and a pernament ban from the arena. Like the waffle situation in Toronto.

throwing fruit at anyone is never a good thing. It wouldnt take much for a judge to see it as a negative action.

There's been talk that it could fall under a hate crime. The waffle guy was different, why he chose waffles nobody knows. The fact that this guy snuck a banana into the building and only threw it when a black player was skating in on a penalty shot makes it pretty obvious what his intent was. I hope they charge him with something just to get his name out there.

I seem to recall that an initial attempt was made at Simmonds as well with a banana but it fell short of the ice? The dude snuck two bananas or maybe a batch for all we know and I doubt it was coincidence. Seems like intent to me....

Regardless of whether it was racially motivated or not, you can't just be throwing things on the ice during a game. If you threw a beer on the ice and the security guard found you, you'd probably be prosecuted for something (disorderly conduct, trespassing, something in that line of crap). The only difference here is there seems to be some sort of investigation into this after the game, which wouldn't happen in the context of chucking a beer on the ice.

Unless the banana was propelled onto the ice via telepathy, thoughts have nothing to do with it.

Most jurisdictions have disorderly conduct, or similar, statutes that make some conduct intended to alarm or disturb (i.e. threatening to harm someone, shouting "fire" in a crowded theater) unlawful.
What's alarming or disturbing? Well, that's what we have juries to determine. But if I'm a black guy and some a-hole lobs a banana at me, I'd be pretty alarmed and disturbed.

In regards to Octopi being thrown on the ice last season during the playoffs Joe Louis employed police to watch entrances in case anyone attempted to do it and was caught they could make an arrest the league threatened to prosecute people throwing them on the ice it was a big deal
