You think Penn State didn't gain a competitive advantage? For fourteen years they avoided the consequences of what happened by covering it up. Do you think the program would have continued on without a glitch if this came out in 1998? Systematically burying the problem and continuing on for a decade and a half as though nothing happened in itself created an unfair competitive advantage.
I still think the penalty wasn't severe enough. It's almost the same as what happened to USoCal.
Some reports showed they knew about back to 1995. Seriously, how do you allow a child rapist in your facilities for the sake of football.
The NCAA had no authority to do this... Some very good lawyers have studied their bylaws and they all agree... If PSU didn't sign off on the penalties they would easily win a civil lawsuit against the NCAA... The NCAA got them to sign off by threatening to put the Death Penalty on the table... The NCAA made this up as they go, and that is NEVER the way to do things... PSU didn't violate one NCAA rule in this, so they attached it to some very obscure part of their mission statement...
Why do you think they got PSU to sign off on this penalty, really think about that... It's because they knew they didn't have the authority to do it...
I learned a lot more about Lack of Institutional Control, and come to find out, this doesn't fit their description.. Lack of Institutional Control is defined as not having in place a system to ensure NCAA rules are followed by the programs at the University Level... So to have LOIC, you must have a violation of the rules that exposes the LOIC...
I am all for putting into their bylaws that no school should cover up any sort of criminal allegation at their schools, but they don't have that rule...
They actually had a meeting in which they discussed that they probably don't have the authority to do it, but they decided to go ahead and test it and threaten the death penalty if PSU doesn't sign off on it... PSU had to sign off, if they got the death penalty, it would probably take years to take the NCAA to court...

I would have thought a cop would understand why the NCAA was completely in the right to do what they did. They had all the authority in the world to hand out that punishment, because Penn State gave them the OK to do so. Penn State gave them the authority.
I don't claim to know the law well, but if Law and Order has taught me anything (), a police officer can't search your premises without a warrant unless you give them permission to do so, correct? You're giving the officer authority he/she didn't have at the time by giving your consent.
I imagine the same kind of thing applies here. The NCAA normally doesn't have the authority to hand out this punishment, but since the school signed off on it, they were allowed to do so.
But we get consent because we don't necessarily have the constitutional right to do so. I can not threaten you though that if you don't give me consent I'm going to put you on death row. Notice the big difference. Consent has to be given of free will and without threat or coercion. That's a HUGE difference in your analogy.
Again, just going off what little info I know/experienced, do police not threaten "obstruction of justice" in order to grease the wheels of uncooperative persons?

So, I felt like doing something whimsical today. So, while at the mall I bought a "Beware of Dog" sign and modified a "U" into it, so now it says "Beware of Doug"
Should look pretty good on the tree in my front lawn I think.
Watching the most random show on Spike, these guys just advised a bunch of little people that they was going to get evicted. They built a 2 story building inside of a regular house to make more room for them.

Also got my wisdom teeth removed today. It was weird, one moment I'm talking to the doctor about getting blood on me, and the next moment I'm pulling cotton out of my mouth (they did the sedation with IV's). Only started to hurt about 30 minutes ago when the numbness from tinkering with the nerve went away, so I'll be posting the entire next week on Vicadin.
There was a time when Chik-Fil-A was more expensive, but other places have caught up. Probably a matter of having their cost-cutting measures come under scrutiny over the years, while Chik-Fil-A was always pretty high quality.
