I know we have a thread started (mods, merge?) but .... IT'S HERE!

Can anyone explain to me why Articels 34 - 46 are left out of the CBA that was posted on the NHLPA Website, and of the document first posted here?

THose clauses appear to have been intentionally left blank, which is a fairly common circumstance in the negotiation and drafting of legal documentation.

In the course of negotiations, the agreement changes constantly, and on occasion it is determined that certain clauses will either become redundant or can be consolidated in other clauses. If one were to delete a clause and then re-number the subsequent clauses, however, that would create a huge problem. As a lot of the clauses are cross-referenced in other clauses, if you were to renumber a clause you would have to seek out and re-number not only the clause itself but every single time the clause is cross-referenced elsewhere in the agreement. That is, quite frankly, a needless pain in the ***. Accordingly, you simply denote the now-missing clause as "intentionally left blank".

To use a concrete example, if clauses 33 to 46 were deleted for the reasons above stated, if you were to renumber clauses 47 to 50, you would have to dig throughout the agreement and renumber each and every time that those clauses are referenced elsewhere in the agreement.

Trust me, speaking from experience there is nothing nefarious about it.

Oooh, purty cover page.

As I previously guessed, the "and in either case has four (4) Accrued Seasons or more on June 30 of the end of the applicable League Year" language is gone. Clearly a remant of when there were less options in the paragraph.

This Kind of Sucks

It looks like this PDF file will NOT let you cut and paste from it - the document security properties disallow "content copying or extraction".

This will truly cramp my style.

Does anyone know a way around this?

I haven't found anything yet. With the new versions of Adobe Reader the authors can prevent the whole "copy and paste" method, I'm not sure if versions prior to 7.0 pick up on this as well.

The CBA is now up on the NHL Site also:

It does not have the nice Article & Exhibit bookmarks of the NHLPA copy, but it does allow cut-and-pasting

I can now stop using the old leaked CBA.rtf and the funky text file extracted above.

i was on another site and found the 1993-2004 one - http://letsgopens.com/nhl_cba.php
but they didn't include the revenue sharing, which is what I'm looking for...

It looks like NHL.com has removed the "archived material from NHLCBANews.com" link from their CBA page.

The archive page is still there:

and the HTML version of the old CBA is too:

IIRC revenue sharing wasn't part of the previous CBA, so you won't find anything on it in the previous CBA.
