Isn't there a clause in the constitution that says everybody has the right to have a fair trial, and be allowed to actually participate at said trial?
It's an administrative proceeding and hence governed by the principles of administrative law which demand that an accused person be given a fair and impartial hearing and an opportunity to respond to the accusations made against him (or her). It's central to the principle of fundamental justice which governs administrative proceedings.
The blindside KO on the head of Tarasenko by a scrub was worse than this. If that hit didn't warrant a suspension. This doesn't either... However, I want the NHL to be harsher in general to protect star players from the mounting head injuries problem.

But now that he wasn't, and now that Schenn wasn't... Pacioretty sure as hell shouldn't be.
I don't even care, all I want is fairness. The issue of what is and isn't suspension worthy is another matter. I just want fairness atm.
Well, we got it. Are you happy with the number of concussions we've had in less than 20 games this season. Taresenko, Gallagher, Skinner, etc. And that's not including the undisclosed ones (Nash, McD) and the concussion-like symptoms (Malkin). Because I'm not OK with it and something has to change.

I wish that Pac would have gotten the suspension. A few years ago, he fakes an injury against the bruins, then when he doesn't get what he wants he starts playing dirty.
In a formal hearing, you can never prove intent without recorded evidence, of which they have none. The history part sucks though.

Yep, but Pacioretty didn't know it was McDonagh...nor did he know that he was about to hit him...nor that he knew that the player was near the boards...nor that he knew that he was actually playing hockey.....
Irrelevant. Pacioretty was suspended last year for a hit on Letang.
Agreed but the Schenn on Gallagher hit is still pretty fresh and, although one poster joked earlier about Bergevin raising it at the hearing, I would be surprised if Bergevin didn't raise it at the first opportunity during discussions. It would put Shanahan in a decidedly difficult situation. Gally had his back to Schenn and never even saw him coming, unlike McD who DID see Patch coming. Gally was extremely vulnerable and about 4-5 feet from the boards and Schenn crossed checked him across the back driving him head first into the boards resulting in a concussion causing Gally to miss several games. In Bergevin's position, I would definitely have raised it with Shanahan and doing so would be fair ball imo.

Should have been a suspension..... Won't complaint but if Callahan have done this to Markov everyone on this board would have call a 4-5 games suspension IMO.
