if Holmgren would of done this and lost the draft picks, we would of heard from his supporters. Who cares. the core is young and its just a measily 1st and 3rd rounder. Or draft picks are overrated. No big loss.

There certainly was a lack of due diligence on checking out the finer details surrounding O'Reilly. It was a pretty subtle thing, as indicated by how much confusion about the application of the CBA in this circumstance. But with so much on the line, there was no margin for error on Feaster's part. He needed to have the NHL's word on this before tendering the offer.
The Flyers' error on interpreting the 35+ rule for Pronger was dumber because it was a more blatant misinterpretation of a clearer situation, but the Flames' error was far worse in the "what if" column.

Coming out of the lockout, we had this conversation because I was told the NHL considers shootouts the statistical equal of ties. I assume that had not been amended in any format. That is limited to shootout losses, not OT losses. I proposed an extreme and obviously unlikely example of a team losing 36 consecutive games via the shootout and whether that would be considered a better streak than going 25-0-10 (25 wins, 10 ties) as did the Flyers. I was told, yes, that 36 straight shootout losses is more impressive than 25-0-10. Imagine losing 36 straight games in the shootout and celebrating that as the longest "unbeaten" feat in history? I guess the word "unbeaten" has to be emphasized with the 25-0-10 mark.

Some issues are open to interpretation and disagreements aren't unique. There should have been steps taken to close any door prior to this, specifically getting a confirmation from the League office. It doesn't appear that was attempted. Lawyers probably interpret such rules differently. Daly's quote within the article avoids the disagreement by being limited to the result of Colorado matching the sheet.[/quote]
At issue is Article 13.23 of the collective bargaining agreement, which states that a professional or former professional player that played in a league outside North America after the start of the NHL regular season must clear waivers before playing in the NHL that same season.
An amendment to that article was made in the latest agreement that ended the long lockout, allowing teams that re-sign their restricted free agents to avoid the waiver process. Therefore, Colorado won't risk losing O'Reilly by matching the Flames' offer sheet.
There doesn't appear to be any protection for a team signing a free agent from another club, but Feaster said that the Flames' interpretation of Article 13.23 "was, and continues to be, different than the NHL's current interpretation."
He also said that the prospect of losing two high draft picks as well as O'Reilly is now a moot point because Colorado matched the offer sheet.
The NHL declined on Friday to clarify whether O'Reilly would have had to clear waivers if the Avalanche didn't match Calgary's offer sheet.
"We agree with the Flames in the sense that the entire issue has become an academic point," NHL deputy commissioner Bill Daly said in an email to The Canadian Press. "Ryan O'Reilly has signed a contract with the Colorado Avalanche and the contract has been registered. We have nothing further to say on the subject."
