Yes, he can always go back to Canada since he's a Canadian citizen with a Canada passport. There's just no guarantee that the U.S. government would let him back in the U.S. to work since the new Work Visa has not been issued yet.
His 10-year Visa expired this summer so as soon as his Lightning contract was signed the paperwork was started (last July). It's just since 9/11 the screening process is very intensive and we all know how the U.S. government takes it's sweet time to get anything done.
But in the mean time the team is screwed if the paperwork doesn't come thru NEXT WEEK. There's four more trips to Canada in December & January, the first trip starting 12/11.
