If we didn't fight the 3rd round pick and the fine, I don't see why we'd be fighting for a 1/3 of the "penalty". To me, you either fight for the entire penalty or you don't.

Not if your argument is that the penalty was too severe. If he does appeal, the Devils can present to the mediator/arbiter/judge that they do acknowledge they committed a wrong but they feel the penalty was too severe.

Or, if Lou decides to fight the entire thing, he can just ask for the pick and the fine to be reimbursed. Maybe in the form of an extra third in the future.

I haven't decided yet (been back and forth) if Lou will appeal. But I think it can go either way. If we make the playoffs and go on another run I think Lou won't even bother. But if we're a lottery team Lou probably gives it one more hail mary pass.

There were different rules in place when the Devils had to forfeit that portion of the penalty. There are new rules in place now that they have to forfeit the final part.

The infraction happened under the last CBA so you still have to follow the old CBA in terms of all punishments involved barring both sides coming to an agreement which I can't see happening.

Actually it's pretty possible. I wonder if that's what's on Lou's mind. Stall this out until the draft and appeal the day before . Doubt it.

I think we'll here something eventually. Wonder if TG might ask Lou? If the Devils take the NHL to court the judge will just toss it out to an arbiter anyway most likely. And the NHL will probably hear it right away. I doubt it's delayed all that much really considering there aren't really super complicated legal matters and witnesses etc... like the A-Rod saga.

Lou will test the water in the back room and then if is denied he will back down. They are guilty. Not just a little bit pregnant but pregnant. Was it too serve maybe but that's in the eyes of the punisher. The new owners knew about the penalty if they cared it would have been a condition of the sale so they accepted it.

I don't think we'll get our 1st round pick back, but...

I do think Lou might use the pick forfeiture as leverage to have Kovalchuk bypass waivers if he ever decides to return to the NHL. Just a thought.

I'm not trying to open a can of worms again about whether fans want Kovalchuk back or not---just stating that I think it would make for good leverage to exclude him from waivers.

Please do NOT mention that name around these parts again.

He is persona non grata now and will be if he even attempts to come back.....

And anyway, this is about Lou trying(or not trying) get an appeal to get the 1st-rounder back(doubtful)....I would love for the NHL to give Lou two high 2nd-rounders, though.

I'm not nearly as negative as most about this issue. I definitely think something could be in the works behind the scenes.

At the very least, I'd think the Devils would non-publicly threaten with a long, protracted, highly-visible, and highly-embarrassing legal proceeding.

Then again, I was 100% wrong about thinking the league would go after Minny for tampering with Parise, so...........

Hmmmm, I don't know how the appeal process would work but it would be interesting to see if they could go that way...maybe before the draft strike a deal where we only give up a 2nd. Really probably just wishful thinking.

Not that my two cents is worth a nickle but...

I can see Lou appealing to have the forfeiture delayed if its a lottery pick. Maybe the league would consider that. But that's the best to hope for, and even that is a slim hope.

Why are we even debating if the pick will be reinstated? It was already confirmed by a reliable source that Lou agreed to NOT APPEAL the decision by the NHL when he accepted the penalty. It is possible that the penalty was even harsher than what it is now (hard to believe, I know) and that this was a mutual agreement by the NHL and Lou for a less severe penalty. In exchange, no appeal.

Appealing now would not go over well with the other owners and will seem a lot like whining or complaining.

Wait, what if Lou does what A-rod does.

By appealing it very late . What if the court ruling doesnt come before the draft ? Soo he kind of pro-longs the time.

If he appeals in June, there is no way the ruling is made by the draft. But he would only do it if we had a high draft pick to give up. So he wouldnt directly ask for a delay in forfeiture , but because the appeal took so long, we would use the pick .

Exactly like A-rod suspension came down. We know he will most likely lose it, but he got to play the rest of the year out

He is the best on the team, but we'd trade him if we were out of playoff contention. Especially since I don't think Lou will re sign him again next year, if he even decides to continue playing in the NHL anyway.

Because he's the best, he could possibly get us a good draft pick that we wouldn't have.

I'm hoping we stay in contention and keep him though.
