AIUI, you can sign SPC (ELS or otherwise) for 12-13 starting as early as 3/1/12. (See Coyle, Charlie signing)
So, I believe they can sign him.
But it might be that they'd want him to play with Worcester on an ATO, and then sign him (say in June) to the NHL SPC.

You cannot be over 50 active NHL contracts, and the only exemption is junior players under age 20. Nieto does not meet that exemption, so based on my reading of the CBA any contract he signs counts immediately.
And no agent with a brain cell in his head will let a player like Nieto play anywhere after BU without a maximum ELC in hand...so since SJ can't sign him that makes it very unlikely he would sign an ATO.

I didn't really mean to play this year but I meant in the future. It seems like there's gonna be a lot of turnover in the non SJ contracts this summer and I don't see why DW wouldn't give Nieto what he's worth.

"Reserve List" means the list of all Players to whom a Club has rights including all Unsigned Draft Choices, all Players signed to an SPC (whether or not currently playing in the NHL), and all Players who have signed an SPC but who have subsequently been returned to Juniors. A Club may have on its Reserve List, at any one time, not more than 90 Players, which shall include the following:
(a) Not more than 50 Players signed to an SPC and not less than 24 Players
and 3 goalkeepers under an SPC. Age 18 and age 19 Players who were returned to
Juniors, and who have not played 11 NHL Games in one season, shall be exempt from
inclusion in the 50 Player limit.
Any Club violating this provision shall be liable to loss of draft choices as
determined by the Commissioner.
