The player would have to pass through waivers. Until there is some groundwork laid between the NHL and KHL on player movement, there won't be any real trades between the two.
I doubt very much the NHLPA would sign off on anything that would allow it's members to be shipped off to Siberia with no say in the matter.

It would be too complicated if a KHL team was to trade away a draft pick (or several picks) for a NHL player or draft picks; then again I would see Gauthier try to ship off Tinordi to Magnitogorsk (if you want to know why I brought up Magnitogorsk, it's because Tinordi is himself a Magnitogorsk draftee) for Sushinsky+Magnitka's first+...
if khl players want to play in the nhl and are good enough they woudl just sign? if this started happening the NHL wouldn't be THE place to play for superstar players and u would see more russian and european players staying in there own countries
While i posted this a while ago it needs to reiterated, I agree that the KHL and other European leagues should receive fair compensation for their players moving to the NHL, this fee wouldn't be paid by the NHL rather instead it would be paid by the team itself ( doesnt count towards the cap) . the following are factors that would be considered when deciding the fee
- Age
- Role on the KHL team
- Role on the NHL team
- Contract
In the event that a player decides to come to North America or vice versa if they have a contract they can terminate the contract with their team, however the player must pay the entire amount themselves, as well the new team must match the offer.
I honestly belive that Washington should have paid UHC Dynamo at least 50 million, thats what the KHL team deserves. While i am an Ottawa fan they should receive fair compensation. Also vice versa Ufa should have paid 15 million to Nashville for compensation ( Due to Radulov honoring his contract with Nashville the fee wouldnt count, but its the only example i could think of.)
In soccer you don't have trades, but something similar.
If a team from a different league wants a player, that player has to first come to an agreement with the new team. The new team then pays the old team to release the player from the contract.
The only problem is a system like that defies everything the league is attempting to establish with income parity. Soccer is instead dominated by a few massive clubs who can buy what they want. Works better on a global scale, as you have other levels of competition/income to keep people interested.

When Russia stops being an ass backwards country that doesn't use intimidation and threats of violence towards players and their families to force them into contracts they don't want then maybe negotiations can begin. But we're at least a generation or two away from that happening.
A bit off topic, but I don't understand why everybody keeps equating living in Russia to living in the depths of hell. The country has come a LONG way since it's financial collapse in 98, and living standards have significantly risen. While it makes a lot more sense for Russian/Czech/Slovakian players to bolt to the KHL for more money, I'm surprised younger NA players have decided against it, perhaps those who find themselves being bounced around between the NHL and AHL.
Atleast for a year or two, simply for the money and the crazy life experience. Playing for CSKA Moscow and being payed handsomely sounds nicer than AHL conditions. Seriously, Moscow/St.Petersburg >>>>>>>>>Any AHL city as far as living in goes.
