Flyers' owner sued over Winter Classic tickets

Jenkintown, Pa.-based Stern & Eisenberg filed the suit against Comcast-Spectacor in New Jersey's Mercer County Superior Court on Friday. The lawsuit says team owners breached the contract by forcing season ticket-holders to purchase tickets to the Jan. 2 Winter Classic at Citizens Bank Park separately and at a higher price

What part of the contract are they supposed to have breached? Anyone got a copy of a Season Ticket Holder agreement/contract?

The suit says fans who bought a 44-game season ticket package for 2011-2012 got only 43 tickets. The plaintiffs say those who bought season tickets were told they would have to purchase Winter Classic tickets separately.

The fees were absurd too, a buddy of mine won the lottery through the NHL and got tickets dead center behind home plate row 1 in the 300 level. He paid no fees just a shipping charge. They rocked the season ticket holders with crazy fees, but I'm not complaining, Spectacor didn't put a gun to my head and make me buy those tickets.

Didn't they refund that money or let you use it as credit towards the playoffs?

They refunded the game to credit use in the playoffs. So we did get 85ish% if a game free.


They didn't play 85% of Game 4 vs. the Penguins, so I count that one.

I personally was way more pissed off we had to purchase Phantom and Alumni tickets, ended up losing 40 bucks on selling the Phantoms tickets.

And also the fees, I don't mind paying convenience fees when there are other ways to buy tickets, but when online is the only viable route, it ceases to be convenient, and is more compulsory fees.

The Flyers didn't force anyone to buy Winter Classic tickets. Won't make it to court.

They have a legitimate beef.
Contract says they get 41 home games.

Yes, they were given the right to buy that 41st game, but adding the rider they must buy 2 other tickets to do so violates the contract.

Phillies and Rangers season ticket holders didn't have to buy those tickets.

Does the contract say that they have the right to buy the 41st home game or did it say you get 41 home games. In other words, if I read the contract at the time I purchased it, would I think I was getting tickets to the WC or would I think I had to buy the tix on top of the plan?

When the majority of people, including myself, signed up for season tickets for this year the Winter Classic was not yet announced. With that said when I agreed to buying season tickets I was under the assumption that I would be getting 41 regular season games and 3 pre-season games because that is what I paid for.

However, i'm sure their is a clause in the contract that protects the Flyers from such legal procedures.
