I just take it as another article that doesn't give us the "Yes" or "No" to the team staying in Phoenix and not really worth reading.

It's a good recap if you don't remain up to speed on a day to day basis.

How on earth, by the way, can you expect a writer to give you a definitive yes or no?

Even if the COG prevails against GWI, JIG comes up with the cash, the BOG approves and the sale is finalized, there will still be a tremendous cloud of uncertainty for AT LEAST another half decade.

The only way the meets an abrupt ending without lingering drama is if the team is relocated or folded.

When the sale of everything happens. Also that cloud will dissapear overtime and sooner with each season the team makes the playoffs and even sooner if a cup in won early on.

Apparently Resnik and Halverstadt will be tweeting live from the hearing. Anyone who knows how to use Twitter want to update us 27 year old grandpas?

After GWI's ramblings:

Quote:
@LisaHalverstadt: Judge Fink: It's my understanding that there's already an agreement that ties #Glendale's hands. #Coyotes
Might mean the 10 year lease signed with the NHL last year...could be a telling quote in how the Judge feels.

GWI is trying to argue that the lease is with three different parties and they all must be put out for bid. They cant be viewed as one big project if I am understanding their rambles correctly.

Quote:
Sitren (GWI): Arena management doesn't meet this standard. "I'm not aware of specialized training for degrees for arena management." #Coyotes
So anyone can manage a mult-million dollar facility? Sweet!

After GWI arguing about the vote passing as an emergency clause versus a regular vote that requires a 30 day waiting period for the vote to become biding (versus immediately with an emergency vote):

Quote:
Judge Fink: I'm unclear why this is necessary. Goldwater could issue release and there's plenty of other publicity too. #Coyotes
I am hoping that I am reading the Judge right and that GWI is just grandstanding but I will wait until COG speaks.

After GWI argued about Glendale not releasing all the exhibits:

Quote:
@LisaHalverstadt: Judge Fink: These are arguments more appropriately made to Judge Anderson, who is hearing records case. #Coyotes
I could be wrong but GWI is trying to merge all of these court issues. Chances of finding something bad would be higher if the whole picture is looked at I believe is what they want.

Quote:
@LisaHalverstadt: Judge Fink: Before #Glendale agreed emergency clause wasn't valid, taxpayers may have had reason for concern but now can try referendum.

#Glendale taxpayers can tell city #Coyotes to "get the puck out" in current situation.
I like this Judge, may rule against my wishes but has a sense of humor.

Quote:
@LisaHalverstadt: Judge Fink: If NHL concludes it's done with #Glendale, one could argue there would be significant harm. May not allow for new #Coyotes deal.
Glendale has yet to speak mind ya.

Glendale time (retweets from Lisa):

Quote:
Birnbaum: Cooper (previous judge) found she didn't have authority to block #Coyotes vote but made "unfortunate" comments after she ruled against Goldwater.

We submitted affidavits from city attorney and economic analyst that can explain operation of #Coyotes arena require pro services.
In response to separating the agreements out:

Quote:
Birnbaum: Goldwater can only speculate that #Coyotes and arena operations may be separated.
Quote:
Birnbaum: We don't want delays. "That may in fact cost us the deal and the city of #Glendale a professional hockey team." #Coyotes

Birnbaum: Goldwater must meet high burden of proof and I haven't heard hardships for plaintiffs. #Coyotes

Something that could derail the fun:

Quote:
@LisaHalverstadt: Birnbaum: acknowledges it's on the books as an emergency measure. #Coyotes

We admit that it didn't pass as emergency. #Coyotes
So Glendale is saying they messed up but it was known as a regular vote after the fact since a citizen already came to pick up paperwork to challenge the vote.

Now Glendale is arguing why another arena manager didn't meet their qualifications (Monarch).

In reference to the "skill level" of running a stadium and why its a professional service:
Quote:
Birnbaum: "With respect judge, you and I could not run this arena." #Coyotes
In response:

Quote:
Judge Fink: What about a window washer? Doesn't he have a specific skills?
Glendale's counter:

Quote:
Birnbaum: It might be a professional service of we're taking about 100-story building. Only certain companies would do that. #Coyotes

To suggest professional services aren't required at #Coyotes arena is tough.
Judge has called for a 15 minute recess, I assume a decision is coming at 12:15

The whole competative bid issue seems like a total waste of time. Of course Jamison is the only potential arena manager who is also a potential owner of the Phoenix Coyotes. That's why his AMF is what it is. He can potentially provide 40 plus dates of NHL hockey. Nobody else can.

MOVE ON!

Sheesh.

I think it's becoming pretty clear that GWI's main goal in this is to drag the process out as long as it takes to get the NHL to skip town. If this day is anything but a total victory for COG the NHL just might give the GWI their way. Unless the NHL is prepared to take the risk of still owning the Coyotes past the point of no return(in terms of relocation for the upcoming season).

Who knows? Maybe PKP is prepared to own and operate the Quebec Nordiques in Glendale, at jobing.com for one season before relocating them. Haha. Wow, what a thought.

Closing arguments coming up:
Quote:
@LisaHalverstadt: Judge Fink: I am concerned to a certain extent about the emergency clause issue but don't think another meeting is necessary. #Coyotes

I am inclined to rule that section of ordinance which mentions emergency clause be invalidated. #Coyotes
Quote:
@LisaHalverstadt: Judge Fink: There was a request that I invalidate the entire ordinance. I'm only willing to say section 7 is inoperable. #Coyotes

I'm assuming 7 is the emergency clause?

Yep. City already agreed it wasn't in effect, so nothing new.

I think so, he is making Glendale and GWI get together to write a paragraph on something and turn it in on Thursday. The Judge closed by saying:

Quote:
Judge Fink: I expect to enter an order soon. #Coyotes
So I am not sure what it all means yet.

He should enter an order that the lawyers just go into a little room, get locked inside with 30 days of food and water, and are told they can't come out until they reach an agreement.

The amount of skill to know who the group is and to yell it loud enough for the reporters to hear is pretty awesome.

Edit:

So I guess the takeaway today is that if GWI can get 1,900 signatures by July 5th to force a public election on the lease vote then the deal will pretty much be dead because we wont know anything until November.

That is not a lot of signatures....I am sure they will say to people sign this if you dont want higher taxes.
