The NHL took a preemptive strike against the NHL Players' Association dissolving the union by filing a class-action complaint in federal court in New York asking for confirmation of the ongoing legality of the lockout.

In a news release, the NHL explained that the move was in response to NHL players being asked to vote on whether the union should proceed to a "disclaimer of interest" status. There are two methods of dissolving the union. Players can have a formal vote to decertify or the NHLPA can disclaim interest, which essentially means it announces that the union no longer represents the players.

"The idea is to get in the most favorable court as possible, and to get home-ice advantage," said associate professor Gabriel Feldman, director of Tulane's Sports Law program. "That's why they struck first. It's a preemptive filing to try to get the case in a friendly jurisdiction. Based on where similar cases have been heard in the past, New York would appear to be a league-friendly jurisdiction."

Still, the season isn't necessarily lost. The National Basketball Players Assn. filed a disclaimer of interest during its dispute with the NBA last year. The sides settled soon afterward. There's still time for a 56- or 58-game season starting in mid-January if Bettman and the owners conclude they've gained enough from players.

"I still suspect that the league has in its mind a break-even point financially, and if it's not a date on a calendar or a particular number of games lost, or whatever, it's some metric by which they know, 'Hey, we're about to pass the point of no return,'" said Borden, the labor lawyer.

"And again, not knowing the full ins and outs of the economics of the league, I would find it hard to believe that they're willing to give up on an entire season. Although each week that passes makes it seem more possible, I just don't think that is as an attractive prospect as it might have been in 2004 in order to achieve their objectives."

Former federal prosecutor assigned as judge to case (and Yankee fan).

The 51-year-old is a graduate of Horace Mann School, Harvard College and Harvard Law School.

He spent a year between college and graduate school as a reporter for The Wall Street Journal. After clerking for Supreme Court Justice Thurgood Marshall, he had two stints in the U.S. Attorney's office in Manhattan, rising to chief of the major crimes unit. He also worked in the Solicitor General's office in Washington, D.C.

NHL Sharks import their ECHL affiliate for game at HP Pavilion to give fans some hockey, and businesses a break (suggestions included patronizing downtown businesses before/after game).

But some came only to see the folks they see around their seats, not the hockey.
