Mediation is ongoing in the CBA process and there is no indication of if it will lead to a big-group, face-to-face negotiating session.

dissolving the union and plunging the NHL into a period of utter chaos won’t count as a victory.

A victory is negotiating a winning settlement for players who have already lost so much and getting them back to work. A victory is finding a way to get the game back on the ice and expanding revenues to such an extent that even a 50-50 split will pour yet more greenbacks into the pockets of even the least talented NHL players.

So we sit back and wait. We adopt Fehr’s favourite strategy. We await the residue of his genius.

And then, when Don Fehr decided not to pull the disclaimer trigger at midnight on Wednesday, which would have turned the talks nuclear, suddenly the clause was enough to render Thursday and Friday moot, with no full collective bargaining sessions, with the poor federal mediator schlumping the four blocks between NHL headquarters and the hotel where the players had set up camp. Suddenly it was being used to gin up outrage and frustration for a re-vote on disclaiming interest in the union, which the NHL maintains is a nuclear move that will end the season, even though in the NBA a deal was reached 12 days after the NBAPA did exactly that.

If the NHLPA disclaims - and that can be as soon as tomorrow at 6:01 - they do so to try and get this settled in short term and save season

To answer questions: (1) It would not be a surprise to see the NHL disclaim interest tomorrow almost immediately following 6pm
(2) Disclaimer not necessarily sham; look at things like whether NHLPA engaged in talks and whether there is intention to re-form PA later
(2) While disclaimer certainly provides clear benefit to players can't say unequivocally sham - employees have right not to be unionized
(3) Disclaimer is designed in short term to save season
(4) Bettman has said if NHLPA disclaims season over; I'm not convinced that is case; only thing that ends season is deadline for season

(5) If disclaim Fehr no longer leads talks - it would be lawyers negotiating on behalf of indiv players; S. Fehr as non-PA lawyer involved 2
