They did have to, and that's why it isn't a concession. And yes, you can still have a negotiation based on the financial issues facing the NHL today. You wouldn't have CBA negotiations based on the players rights in 1994 would you?

Its bizarre and stupid.. and goes against most union/ownership bargaining sessions/deals.. but **** if they knew this.. than just go with it. No time to have a big ego. If everything is in writing then look at it and sign it.

I see when this CBA is finally done.. him just saying something or doing some paperwork wise that just rubs everyone the wrong way, and just more bad blood being made. There is no way he's at the table for the PA at the next cba.. whenever that is.

This is the problem, from what I can see. The owners are dictating, not negotiating. The players have made ever consession up to now.
That's because the NHL are the only ones putting forth realistic proposals...
The NHL and the owners came to make a deal this week. They added even more money to the pot in an effort to get this wrapped up. They thought it was SUCH a done deal that they alerted their GMs and coaches to get ready for the season. The players, in turn, asked for more and more. The owners laid out "the hills they die on" (IE: their bottom line) and asked for a simple answer and they didn't get an answer... instead Fehr went to the press and said they were "really close"
That's a bull **** move any way you slice it. I don't care how much you loathe the owners.
Just ask yourself this: do you/the players REALLY think that holding out right now will get them a better deal in ~3 weeks? After missing another chunk of games? The answer is no. Simple as that. The time to strike a deal was now and they blew it. They ****ing blew it.

Fehr failed at the one absolute tenet of Collective Bargaining. He misjudged where the tipping point was.
All negotiations have one. Be it labor, buying a house, anything...
You have to read your opposition and know where it is.
The players are going to be in trouble if they think they'll gain by this. I liken it to going down in the Titanic. They will get less and less as everyday goes forward.... and if the NHLPA thinks they will benefit from de-certification, they're bigger buffoons that what is already apparent. The VAST majority of the players will not benefit from de-certification.

I'll try and find the quote after I get out of class, but I read last night that Bill Daly said the reason Fehr coming in could kill a deal was not Fehr, but the way the players went about it. Apparently it was not "We need to consult our union head so we can move forward with this" but it was more along the lines of "This player/owner dynamic is not working for us. It's over. From this point anyone can be involved in the negotiations, and that's not negotiable at all."

This is true but it is also true that he makes $0 for all the games lost. I would agree that the rebound in revenue and fan loyalty after the last lost season probably emboldens the owners to not sign a deal at any cost just to get on with it. But everybody is losing the way things are now, I'm sure all involved, directly or in related businesses, are noticing the missing $ by now. I don't believe for a second that anybody involved in the labor dispute "doesn't care" if there's hockey or not - it's just a matter of how thoroughly they are willing to scorch the earth to get what they want. And the answer is surprising as it turns out. Potentially 2 lost seasons out of 9. That's pretty amazingly inept.
