It was accidental. The linesman started to fall and instinctively grabbed Yakupov, taking him down and ripping up his knee. Shouldn't have happened, but wasn't "deliberate".

That's a pretty simplistic and unrealistic view IMO. What happens in the workplace, stays in the workplace? This wasn't some freak accident, a random collision or normal "perils" of the job. This was outside the bounds of normal work place activity.

Yeah, doctors just do neck surgery for the hell of it.

He's not getting these surgeries if they aren't medically necessary.

Tort law

Did the defendant owe a duty of care to the plaintiff?
Was that duty of care breached?
Did the plaintiff suffer damages due to the breach?

If all of the above are met, the defendant may be liable for damages in tort law.

Not every physical problem comes immediately. Just because you think you're fine doesn't mean you are.

Getting crosschecked in the back when you're wearing padding is no big deal. Getting crosschecked in the back with NO padding is another thing entirely.

Have to think that because of the neutral arbitrator dropping the suspension to 10 games twice (once on appeal by Wideman and again when the NHL appealed that decision) that there is no evidence of intent for the hit.

The onus will be on Henderson's lawyers to prove intent and I can't see there being sufficient evidence to support that claim. My guess is that they're hoping for a settlement.

The guy hasn't officiated another game. He legitimately needed back surgery. Where do you get that he is trying to "milk" anyone? Hating or loving the Flames has no bearing on this at all, the guy legitimately can not do his job anymore because of that hit.

Just how much is the NHL paying linesmen these days? I suppose that he's assuming a promotion to referee (which presumably pays more) at some point, but, still, he couldn't have had more than 10 years left in the league and I doubt that they're paying these linesmen/referees a million per season. I can sort of see $10M being justified as medical expenses for all of those injuries for the rest of his life, but claiming that it's for lost income seems a bit dubious.

Wouldn't the linesman get workers comp because he was injured on the job? It's a bad situation though, being too hurt to do your job makes you feel useless.

What a joke that this guy was allowed to actually return to the ice and play out the rest of the season. The NHL is amateur hour every night. Imagine someone injuring a ref to this degree in any other sport, do you think these athletes would be allowed to play again?

These morons play with sticks that could be used as weapons, they use them as weapons, use a derpy derp defense and it works? Hockey sticks hurt and they constantly swing them at each others heads, sometimes intentionally, and the league is ok with it. And they wonder why nobody takes the NHL seriously outside of Canada?

He doesn't have to prove intent. This is (I'm assuming) a battery claim. He just has to prove that it was not in the normal course of the event. You can negligently batter someone.

The NHL tried. They dropped the max suspension on Wideman and got overturned by an overreaching arbitrator.
