No we don't have to sign Emelin this summer, it would have been the case because all Euro picks from the '04 draft need to be signed this summer but Russian players are not counted due to them not being in the NHL-IIHF PTA. At this point there is no time frame for when we will lose the rights to Emelin, but the NHL could change it at any time, although one would think that if the nhl changes their policy, they will give nhl clubs a good amount of time to sign their Russian picks.
Off topic of sorts but I understand there is some concern for when the nhl will get this worked out, as the Sabres have a comp pick for not signing their 1st round in '00, so you got to think they are hoping this gets worked out at some point soon so they can get an extra draft pick.

That's actually not correct Marc,
For the old cba, they broke it down by years up to and including the '04 draft.
So for '05 it was all Euro picks up to '01, then for '06 it was all Euro picks from the '02 draft, in '07 it was the '03 (and '05) and in '08 it's the '04 (and '06).
But the league chose to let teams keep their Russian picks due to them not signing the PTA between the IIHF and NHL. So we still hold the rights to Emelin, Sidyakin and Kruchinin as far as I know.
