this will never hold in court cuz him sitting in the first row means he accepts the risk...

but there must be some need to prove that the habs did not take reasonable precautions.

I can't see them getting anything. The Canadiens would have had to be at fault to be liable for any damages, which isn't the case here.

This happened in Pittsburgh. Mario Lemieux was sued once because a puck shot by Lemieux deflected into the crowd and injured a guy. He sued Mario. I think Mario gave the guy some money to go away.

The Habs will probably do the same with this duffus.

Unfortunately, as much as everyone knows it's probably a fake (the whole nightmare part is to claim a post traumatic stress) it is most likely that the Habs will settle offcourt, probably for a lot less money. They do not want bad publicity and that's the leverage this guy's lawyers have.

It happened before. And the legal value of the disclaimer is debatable.

Mon is right. Just because it is printed on the back of the ticket it doesn't mean ****. I took a law course last year and my professor said the same thing as his. It obviously all depends on the situation though and a good lawyer could do anything.

I don't know why, but I laughed heartily at that.

This guy deserves to eat glass.

I hope not... cause then everyone will try this. make an example out of people like this and go to court with them and let them waste their own money and time and get their ass kicked by the best lawyers the habs can buy

Read the article in the Journal the Montreal, and couldn't help but laugh at the part where the plaintiff qualified Bouillon's attempt to clear the zone (which broke the glass) as a ``tir violent sans avertissement``

basically means he's almost suing bouillon for his attempt to clear because it was a violent shot that came without warning

probably means that this guy will have his case thrown out and he won't be attending any Habs games any time soon.

Of course there are all sorts of ways to tie up the legal system if you want to...
Not worth anything...
Section 1474 C.c.Q
But this case is going no where

If glass would chatter I would say "Shut up I'm trying to watch the game!"

But in all seriousness, as much as you do enter into a contract when purchasing a ticket there is a loop hole in every contract. If it was due to negligence or anything he would have a point but in this game, he's got jack.

Anyone know what happened to the case where the girl died after getting hit by a puck in Minny?

It was in Columbus. The girl's family got $1.2 million.

What a ******.

I think he'll probably get $10,000 - $15,000 out of court from the Canadiens to go away before any bad press comes from it.

Nightmare is lawyer talk. Lawyers coach you into saying things for jury sympathy. Just like the perfect father and husband for 10 years suddenly becomes an accused wife beater so the ex wife can get the kids and as much money as possible.
