Another NCAA/CHL Question

There is much talk on the Rangersrush message board that now since Ranger property Vinny Saponari has been booted from Boston University of the NCAA, is he even eligible to play in the OHL next season?

Saponari played on the U17 and U18 NDTP teams and would apparently be a decent OHLer. However, my question is that since he is a 1990 birthdate, doesn't he fall under the "Mike Van Ryn" rule where you cannot move from the NCAA to the OHL to play an OA season?
