If a player is under contract and assigned overseas, the player can return under certain circumstances and not require waivers. For example, Tom Wandell was loaned to Sweden while on his ELC and when the Stars had a need at forward, they brought him back over had him play in a few games and then Wandell went back to Sweden.
I believe this was under emergency conditions and that it was one of the conditions of allowing Wandell to go to Sweden, but he didn't require waivers to return and play in the NHL that season.
