Just battery, not assault, so the contact was relatively minor in nature (shoving, etc), but still not good.

From my reading of his alleged conduct, I imagine he will end up pleading no contest to disorderly conduct and pay a fine, maybe be ordered to do some community service. It's not going to be a big deal.

I feel that battery is worse than assault, since assault doesn't require physical contact to be a crime. Battery does.

Either way, I'm so tired of his drama and stupidity.

In some states there is no longer a distinction between assault and battery. Assault is the apprehension of attack, while a battery is the unconsented to harmful or offensive contact. Battery Upon a police officer is a misdemeanor carrying a possible $2,000.00 fine + penalty assessments (ends up being between $6.5K and 8K) and/or 1year in a county jail. Assault is often charged as an attempt at a battery, such as if Avery took a swing but missed the cop. He would likely have then been charged with assault.

Perfect Question for my first post in 40 days or so.

I read this on TMZ.com and thought it was Hilarious!!

NHL star Sean Avery challenged cops to a FIGHT when they responded to his Hollywood Hills home this morning ... calling them, "Fat little pigs" ... law enforcement sources tell TMZ.

We're told cops were dispatched to the home over a complaint about loud music -- and when they arrived to Avery's pad, the hockey star was NOT happy to see them.

Sources tell us 31-year-old Avery immediately began running his mouth at the cops -- telling them he would fight all of them ... even challenging them to, "Come back without your badges."

Isn't assault of an officer a felony also?

I don't know what the hell Avery's problem is... cops say the music's too loud, just turn it down. It's really that simple.

It's a classic case of someone suffering from little man syndrome, otherwise known as Napoleon Complex. For Avery, his viewpoint has always been him against the world. He's clashed with teammates, coaches, and now cops. Doesn't seem like he has much respect or regard for authoritative figures.

Saw Avery on the monitors yesterday while I was at Del Mar. His horse... "Sean Avery" won the featured race at Saratoga as a hug long shot. Avery though dressed up still looked like crap. Thought it was funny and typical that his horse shared his name.
