If a person had never heard this horrible music, there would've been a chance that they might've bought the CD by mistake (ie: based on the cover). The damage is clearly in the publicity. Any person that actually heard the music, would laugh at the idea of paying money to listen to it. Therefore, the Devils clearly hurt this guy's sales!

I should say that I agree with this -- if the Devils used the music without a license, then they're clearly guilty of infringement -- but the $30m claim is retarded.
Copyright infringement is an interesting area, because the plaintiff doesn't have to show actual damages, and can elect for statutorily defined damages instead. Although I'm not a copyright attorney, I did take a copyright law class, and from what I recall, a willful infringement carries a maximum penalty of $150,000 per violation (it seems unlikely that they'd succeed in proving that the infringement was willful so the damages would be significantly less). Assuming 41 violations, that figure would be just over $6m. So that means this guy is claiming $30m in actual damages.

The song sucks anyway. Generic rhythm guitar I'm sure they stole from another song + drums I could play in 8th grade + crazy random solo = garbage that shouldn't be paid for.
